::: MEMORANDUM OF ASSOCIATION
:::
1. NAME OF THE ASSOCIATION
This association shall be called the
DELHI TAEKWONDO ASSOCIATION.
2. HEADQUARTERS
The registered office of the Association
shall be located in the jurisdiction of the State of
Delhi at present located at House
No. 621, Pocket-3, Paschim Puri, Delhi-110063, at present
located at (Address).
1. JURISDICTION
The jurisdiction of the Association
shall extend over the whole of the State of Delhi.
2. AIMS AND OBJECTIVES
a) To be sole Association responsible
for promotion and development of Taekwondo in the entire
State of Delhi.
b) To affiliate itself to Taekwondo
Federation of India (TFI) and State Olympic Association.
c) An association for the development
of the Art of Taekwondo, an ancient martial art. To
promote Taekwondo as a way
of life, a philosophy and on art of endowing with discipline
and self-confidence. Taekwondo is a cultural art and
sport to train
the mind and body; to promote goodwill, friendship,
sportsmanship and mutual understanding and closer
national fraternity.
d) To further the cause of Olympic Movement and do everything
that may be necessary or expedient to keep the Olympic
movement completely independent and entirely free from
government, political, religious or communal influences
in the state.
e) To be the channel of communication between its affiliated
units and the Taekwondo Federation of India (TFI) and
State Olympic Association.
f) To grant affiliation to the District Taekwondo Associations
(DTA) as well as State level institutions and sports
bodies promoting Taekwondo in the State.
g) To control affiliated members in accordance with
the constitution and bye-laws of this Association within
the jurisdiction of the state.
h) To collect funds for the state competitions; participation
of teams in the national championships; training of
the players; and other activities for the promotion
and development of Taekwondo in the state. The funds
collected for belt grading, ID cards or any other examination
/ refresher course shall be in accordance with Taekwondo
Federation of India, herein after called TFI in short.
A receipt shall be issued to the athlete or competitor
clearly explaining the activity for which the fee is
being charged.
i) To make rules and regulations in pursuance of the
subject to this Memorandum of Association.
j) To give training to students to attain proficiency
in the art of the Taekwondo which gives perfection in
the art of the Taekwondo; perfection in thoughts words
and deeds along with self-defense.
k) To organise regular state level championships at
least one in every year; exhibition and demonstrations
of the art of Taekwondo as and when possible; and such
competitions as allowed by the Taekwondo Federation
of India (TFI) for making this ancient art of self-discipline
and self defense more popular in the state.
l) To maintain library for the benefit of the athletes.
m) To maintain record and panel of qualified referees
and instructors of the district; to ensure that they
impart training as per rules and regulations of the
TFI and World Taekwondo Federation (WTF).
n) To grant financial assistance to players and affiliated
members, if funds permit.
o) To make, alter, maintain, and enforce the rules and
regulations for the control and governance of the game
and maintain discipline and spirit of sportsmanship
and camaraderie amongst players, officials, DTAs etc
in the State.

CONSTITUTION
1. NAME OF THE ASSOCIATION
DELHI TAEKWONDO ASSOCIATION
2. ADDRESS OF THE OFFICE

3. DEFINITIONS & EXPLANATIONS
Unless otherwise indicated by the context:
1. ‘TAEKWONDO’ means the sport of ancient Martial Art
promoted by World Taekwondo Federation (WTF), an affiliated
unit of International Olympic Committee (IOC).
2. ‘Association’ means the State Taekwondo Association
in short “STA”.
3. ‘Member’ means sports promoting unit or body promoting
/ involved in the discipline of Taekwondo and affiliated
with the Association and given membership as per the
provisions of this constitution. A Member does not mean
& include individuals or office bearers.
4. ‘Representative’ means office bearer of the affiliated
DTA & Member unit who has been authorised to attend
the meetings of the Association in accordance with provisions
hereinafter contained.
5. ‘General Assembly’ means and includes the representatives
deputed by the members in accordance with rules herein
after contained.
6. ‘Constitution’ means the constitution of the State
Taekwondo Association.
7. ‘Executive Council’ means the Executive Council of
the Association constituted under the Rules and Regulations
hereinafter contained to whom the management of the
affairs of the Association is entrusted.
8. ‘Office Bearers’ means the office bearers of the
Association elected in accordance with the rules and
regulations hereinafter contained.
9. ‘TFI’ means Taekwondo Federation of India affiliated
with Indian Olympic Association (IOA) & World Taekwondo
Federation (WTF).
4. MEMBERSHIP
a) The membership of the Association will be open to
the under mentioned Sports promoting units / institutions
of the state, subject to approval by the Executive Council:
1. District Taekwondo Associations promoting Taekwondo
in the district as per WTF Rules
2. State level Sports Institutions in the state promoting
Taekwondo
3. Educational Institutions promoting Taekwondo having
their units in more than 50 % of the districts of the
state.
4. State government organisations like police, electricity
boards, transport corporations promoting discipline
of Taekwondo in the state
5. Any other state level institution involved in promoting
and developing Taekwondo as the Executive Council deems
fit
Note: No individual or office bearer of this Association
can be given or treated as Member of the Association.
The voting powers shall be vested only with authorised
representatives of the Members given membership as per
Art. 4 sub-paras i) to v) above.
b) The STA would have all unresolved disputes settled
by the TFI. The STA & its Members voluntarily surrenders
their right of seeking redress in any court of Law at
the first instance.
13. All affiliated Members shall commit themselves to
voluntarily surrender their right of seeking redress
in any court of law at the first instance. They shall
appeal only to the President TFI, who shall place the
matter before the next immediate Executive Council meeting.
14. A member shall neither be affiliated to any other
STA not recognised by the TFI nor participate in any
Taekwondo events organised by such an organisation.
15. Any appeal by DTA / Member Unit complaining against
the procedure adopted by the STA for holding “Elections”,
or any other issue connected with this subject must
be made in writing, to the TFI within 30 days of the
occurrence of the incident. No complaint will be considered
valid or entertained by the TFI if it is made after
the expiry of the 30 days period. The complaint must
be specific and contain documentary evidence to prove
the issue that is disputed.
5. MEMBERSHIP FEE (Admission Fee & Annual Renewal
Fee)
1) Every affiliated member shall pay the following fees:
A) i) Affiliation fee: Rs. 200 /-
ii) Annual Renewal fee: Rs. 100/-
2) The annual membership fee of all affiliated members
shall become due on 1st April every year & shall
be paid by 30th of April. Defaulting members will be
debarred from attending any meetings, if they do not
clear all of their pending dues by 30th June of the
current year. Fee for delayed payment will be charged
@ Rs 10/- per month from 1st of May till 31st March
next year.
3) Failure to pay membership for one full year shall
result in disaffiliation of the Member. For example,
if the annual renewal fee is due on 1st April 2008 &
the member fails to pay the fee along with delayed payment
till 31st March, 2009 the membership will cease automatically.
4) In the event of disaffiliation, fresh application
must be submitted for affiliation to STA. STA will be
competent to form an adhoc body tp safeguard the interests
of the athletes and clubs in the district. The adhoc
body will only look after the routine work of the DTA
for a maximum period of six months. In the meantime
STA will take steps to order fresh elections of DTA
under intimation to TFI.
6. FUNDS
The funds of the Association shall be kept in a Nationalised
Bank. The amounts can be withdrawn from the bank by
means of cheque signed by the President along with the
Secretary or the Treasurer. For amounts exceeding Rs.
25,000/- the signatures of all the three i.e. the President,
Secretary & treasurer will be necessary.
1. STRUCTURE OF THE ASSOCIATION
1. GENERAL ASSEMBLY
It is the Supreme Governing Body of the Association
having full powers. The General Assembly comprises of
President and Secretary of each Member or their authorised
representatives. Each Member of the Association is authorised
to send only two representatives. The Office Bearers
of the Association do not have a voting right in General
Assembly unless they represent a Member of the Association.
The President of the Association shall preside Annual
General Assembly meetings. Only eligible Members as
per provisions of this constitution are permitted to
send their two representatives.
2. EXECUTIVE COUNCIL
The Executive Council comprises of elected Office Bearers
of the Association. The Office Bearers are elected as
per Article 8 of this constitution. They are elected
for a term of four years in the Annual General Meeting.
The President is the Chief Office Bearer of the Association.
The elected office bearers have been entrusted duties
as provided in the constitution.
2. MEETINGS
i) ANNUAL GENERAL ASSEMBLY MEETING
The Annual General meeting shall be conducted once in
a year preferably during the State Taekwondo Championship.
The quorum for the meeting is one half of the eligible
members. Fifteen days prior notice shall be given to
all the members. The notice shall include the agenda
for the General Assembly. One copy of the notice shall
be affixed at the Notice Board of the Association and
one copy sent to the TFI and State Olympic Association
(SOA), in case affiliated with it.
The normal Agenda amongst other things shall include:
i) Confirmation of the minutes of the last General Assembly
meeting.
ii) Consideration and adoption of the Annual Report
of the Secretary of the Association.
iii) General Elections, if due.
iv) Preparation of sports calendar for conduct of various
championships at state level
v) Considering and passing the audited statement of
accounts for the previous financial year and the budget
for the next year.
B) EXECITIVE COUNCIL MEETING
The Executive Council shall meet at least once in a
year. The quorum for the meeting shall be one half of
the elected office Bearers. One week notice shall be
given to all the members of the Executive Council.
C) SPECIAL GENERAL MEETING
Special General Meeting may be summoned at any time
by the President at his discretion
and/or
shall be convened by the President of the Association
within 15 days on a written requisition signed by not
less than fifty percent (50%) of the Presidents of affiliated
members.
3. ELECTIONS
Elections shall be held once in four years at the Annual
General Meeting of the General Assembly to elect the
following office bearers in the presence of TFI observer:
1. President One
2. Vice-Presidents Two
3. Secretary One
4. Joint Secretaries Two
5. Treasurer One
6. Executive Council Members Maximum Five
10. VOTING
1. The Electoral College comprises of authorised representatives
of Members as per Art 4. Each Member is authorised to
send two representatives who shall be regular office
bearers of the affiliated Member. The member should
be eligible to send representatives in accordance with
the provisions of this Constitution.
2. Voting if necessary, for the elections of the Executive
Council members of the Association shall by show of
hands or secret ballot as decided by the assembly.
3. For election of Office-Bearers of the Association,
only the ‘authorised representatives’ of the Members
(two per unit) shall be eligible to participate and
cast their votes.
4. The office-Bearers of the outgoing body can not form
a part of the Electoral College unless they represent
a Member.
5. In case of any ambiguity, the election procedure
of TFI shall be adopted.
11. TENURE OF POSTS
a) The office bearers shall hold office for a term of
four years from the date of elections. However, the
Executive Committee is competent to extend the period
for holding elections with the prior approval of TFI
within six months of the expiry of term. The period
of six months cannot be further extended under any circumstances.
b) If the Association fails to elect office bearers
as stipulated, the TFI will be at liberty to constitute
adhoc committee and call upon all the DTAs to assemble
at a fixed date, time and place and elect office bearers
in the presence of TFI & SOA observers.
12. HOLDING OF OFFICE
2. No office-bearer of the Association shall be eligible
to be the office-bearer simultaneously of any other
martial arts promoting body. This restriction applies
for the posts of President, Secretary & Treasurer
only.
3. If an Executive Council member absents from three
consecutive meetings of the Executive Council without
leave of absence of the Executive Council, the concerned
member would be deemed as removed from office. This
provision, however, does not apply in the case of a
member who absents for the three stipulated/consecutive
Executive Council meetings in case the member is deputed
to attend on behalf of the Association other meetings/functions
connected with the Association.
i. POWERS, FUNCTIONS & DUTIES OF
1. GENERAL ASSEMBLY
A) To formulate and enforce the policy of the Association.
B) To carry into effect the objects of the Association.
C) To hold elections of the Office Bearers of the Executive
Council every four years in accordance with the provisions
of this Constitution.
D) To approve the membership granted by the Executive
Council
E) To approve disaffiliation of members as per provisions
of this constitution
F) To hold and control the funds and other properties
of the Association
G) To appoint committees or sub-committees, as and when
necessary.
H) To enforce all rules and regulations of Taekwondo
Federation of India (TFI) & World Taekwondo Federation
(WTF).
I) To enforce and defend the exclusive right of the
Association
J) To be the official organisation in complete and sole
charge of all Taekwondo matters in the state.
K) To have power to frame byelaws and rules which are
consistent with the institution.
L) To be the Supreme Governing body of the Association
in all matters pertaining to Taekwondo in the state.
xiii) To amend the constitution as per procedure laid
down in the constitution.
B) EXECUTIVE COUNCIL
i) To conduct the business of the Association and frame
guide lines for the members.
ii) To sanction any expenditure above Rs. 25,000/-.
(Rs. Twenty five thousands only)
4. To approve guidelines for the conduct of Taekwondo
in the state.
5. To ensure that Office Bearers function within their
prescribed functions & duties.
6. To interpret the provisions of the constitution for
which the decision of the council will be final.
14. DUTIES OF OFFICE BEARERS
A) PRESIDENT
1. To preside over all the meetings of the General Assembly
and the Executive Council.
A) To implement the objectives of the association.
B) To sanction expenditure up to Rs. 25,000/-. (Rupees
Twenty five thousands)
C) To deal with disciplinary matters arising in the
Association or the member units.
D) To appoint staff, auditors for the association which
will be ratified by the Executive Council in its next
meeting.
E) To issue guidelines to the members as per decisions
of the General Assembly/Executive Council.
F) To ensure that State level Championships are held
every year.
G) In case of emergency requiring immediate action,
he may adopt such measures as the circumstances may
deem fit. Such action shall be got approved by the Executive
Council in the next sitting.
H) To call for meetings of the General Assembly; Special
General Meeting & Executive Council at a convenient
date time & place by him or through Secretary of
the Association.
B) VICE-PRESIDENTS
7. One of the Vice-Presidents (authorised by the President)
will preside over the meetings in the absence of the
President.
8. To perform such functions as authorised by the President.
9. One of the Vice-Presidents will assist the President
in promotion of the game while the other Vice-President
will assist in mobilisation of funds.
C) SECRETARY
a. The Secretary shall be responsible for the day to
day activities of the Association as per directions
of the President.
b. To organise state championships in senior, junior
and sub-junior weight categories once every year.
c. To maintain the movable & immovable assets of
the Association.
d. To maintain records; minutes of the meetings of the
Association.
e. To ensure that each member follows the guidelines;
directions; rules & regulations of the TFI.
f. Convene the meetings of the General Assembly; Executive
Council and prepare Agenda at the directions of the
President of the Association.
g. Scrutinize, authorise expenditure and pass all the
bills up to Rs. 2500/- per item.
h. To maintain an imprest of Rs. 2500/- for day to day
expenditure.
i. To prepare Annual Report of the Association in consultation
with the President. The report has to be approved by
the Executive Council before it is placed before the
General Assembly.
D) JOINT-SECRETARY
i) They will assist the Secretary in discharging his
duties. In the absence of Secretary, the Joint Secretary
(authorised by the President) will perform the functions
of the Secretary.
ii) They shall perform such duties as may be assigned
to them from time to time by the
E) TREASURER
1. The Treasurer shall issue regular receipts for all
sums received by the Association.
2. He shall deposit all the amounts received by him
within three working days in a bank preferably Nationalised
bank or same bank where TFI is maintaining its accounts
for easy transfer of funds as may be approved by the
Executive Council.
3. Maintain Vouchers for Expenditure.
4. Help the Secretary in preparing periodical statements
of receipts and expenditure for the approval of the
Executive Council.
5. Maintain bills, registers as prescribed by the Executive
Council.
6. The Treasurer is responsible for getting the annual
accounts approved by the Executive Council and audited
by the auditor, under the guidance of the President
& or Secretary.
7. He shall maintain an imprest of Rs. 500/- at any
time.
15. AMENDMENT OF THE CONSTITUTION (PROCEDURE)
An amendment of the constitution can be carried out
in the following manner:
3. Any proposed amendment will be submitted by the Member,
desirous of such amendments, to the President or Secretary
of the Association in writing with full justification.
2. The Secretary will place this in the next meeting
of the Executive Council with the approval of the President.
3. If approved by the Executive Council or as amended
by it, the proposed amendment(s) will be circulated
by the Secretary to all the Members fifteen days prior
to holding the General Assembly Meeting.
4. The amendment shall be passed by at least two third
members present and voting. The quorum for such meetings
shall be two third of the eligible members. The presence
of the observer from TFI will be mandatory to ensure
transparency and fairness in the amendment proceedings
of the constitution.
Note: Above procedure is mandatory. No amendment in
the constitution of the Association without following
the above procedure would be valid. Any other procedure
followed, non-conforming to the above, will be violative
of the provisions of this constitution and the amendments
shall be treated as ‘null and void’.
16. GENERAL DISCIPLINARY REGULATIONS
Violation of the existing rules cannot be excused on
grounds of ignorance of the said rules.
Whoever incites a member Unit to commit an infraction
or aids and abets the said Unit to undertake infraction
shall be sanctioned in the same manner as the Unit which
commits the infraction.
All Members/Constituent Members of the Association shall
undertake to supply to the Association a copy of their
respective statutes, Constitution and Rules & Regulations,
a list of their respective office-bearers and Members,
a copy of Annual Report of their activities, duly approved
by their Executive Council, within six months of the
closing of the financial year, along with a calendar
of sports for the ensuring year. Failure to supply this
information within the stipulated period will constitute
a breach of this rule and may render the defaulting
Member to disciplinary action under these rules.
Any member or the Office Bearer of the Association is
bound to follow the provisions of this constitution
failing which, they can be disaffiliated or removed
from the post they are holding. Any such action will
have to be passed in the executive council by a majority
vote of the members present and voting. The quorum for
disciplinary matters is one half of the Executive Council
members.
All members are bound to follow the dope control tests
as circulated by Indian Olympic Association and adopted
by TFI.
